In the event a legal investigation is initiated by a law enforcement agency, JAG Computer Services will cooperate fully in providing all requested information. Sites that host pornographic content, other content in violation of copyright law, or any other material deemed inappropriate by jagcomputerservices.com, are prohibited. If JAG Computer Services determines that a site is in violation of this provision, the account will be deactivated immediately, the entire site will be deleted without notice, and no refunds will be given. Bandwidth Usage: All JAG Computer Services accounts come with a specified amount of monthly transfers. In the event the client exceeds their allowed bandwidth, they will be notified and will have the option to upgrade to a plan with higher transfer limits. Each subsequent time the client exceeds the maximum transfers for their service level, the client will be charged for the overage at a rate of $5 per GB. Email Abuse: Sending unsolicited email in large quantities through the JAG Computer Services network, commonly known as "spamming", is prohibited. If a violation of this provision is detected, JAG Computer Services reserves the right to terminate services to the client without notice or refund. Server Abuse: Any attempt to undermine or cause harm to a server, or customer, of JAG Computer Services is strictly prohibited. Chat Rooms: We do not allow clients to install their own chat rooms, as they commonly consume excessive system resources, affecting other customers’ quality of service. We also do not allow IRC or IRC bots (such as eggdrop) to be operated on our servers. Billing: All accounts will be billed using the terms agreed upon at point of sale. Any accounts over 5 days past due will be suspended until payment is made, and will be subject to a $10 reactivation fee. If payment is made by check and funds are not available, the site will be suspended until new payment is received and validated, and will be subject to a $25 NSF fee plus a $10 reactivation fee. Outstanding fees must be received prior to the next billing date. If an account has 2 NSF charges within 6 months the account will be deactivated immediately, the entire site will be deleted without notice, and no refunds will be given. Limitation of Liability: JAG Computer Services uses high-quality components in our web-hosting servers to minimize the possibility of failures. While we do take precautions to minimize downtime in the event of a failure, JAG Computer Services will not be held responsible for any damages, consequential or incidental, resulting from the deletion or corruption of files or websites on a JAG Computer Services server. Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion. Reserved Rights: In addition to the items mentioned above, JAG Computer Services reserves additional rights as a part of this agreement. JAG Computer Services may choose to remove any site from the system without reason if it is decided to be in the best interest of the majority of it's customers, provided that any unused portion of the clients' payment for services is refunded. We will not refund any applicable setup or reactivation fees. Furthermore, if for any reason a lawsuit is brought against JAG Computer Services, the laws and regulations of the State of Pennsylvania, County of Berks, and city of Robesonia, will be upheld.
